US Customs and Border Protection had received 297,887 refund declarations through its CAPE process as of 2 October, according to a weekly trade roundup by the law firm Foley & Lardner.

The claims follow the 20 February 2026 ruling that struck down the IEEPA tariffs. On 8 October, a judge sided with importers in a refund dispute, the roundup reports. Separate litigation over Section 122 tariffs is on hold pending appeal.

The roundup also says CBP is using more data analytics to flag classification, value and origin errors, which has led to more requests for information (CF-28s) sent to importers.
